Terms of Service
These Terms govern your access to and use of translationsflorida.us and our online services, operated by EKO 4 Global Services Ltd, trading as EKO 4 Translation Service Florida. By using the Website, requesting a quote, placing an order or otherwise communicating with us through the Website, you agree to these Terms. If you do not agree, please do not use the Website.
1. Our services
EKO 4 provides professional language services, including certified document translation, professional translation, interpretation, website and software localization, and apostille-, notary- and immigration-related translation support, together with related business and government translation services (the "Services").
The descriptions of our Services on the Website are for general information only. They do not form a binding offer and may be updated or changed at any time.
2. Eligibility
By using the Website, you confirm that you are at least 18 years old (or the age of majority in your jurisdiction) and have the legal capacity to enter into a binding contract with us; or that you are acting on behalf of a company, organization or public body and are authorized to bind it.
3. Placing orders and quotes
You can request a free quote or place orders through the Website, by email, or by phone. When requesting a quote or placing an order, you agree to provide accurate and complete information; ensure the documents you submit are legible and suitable for translation; confirm any deadlines or specific formatting, certification or legalization requirements in writing before we begin; and review and approve any proofs or drafts within a reasonable time.
Quotes are usually based on the type, word count, language pair, complexity and deadline of the material you submit. We may revise a quote if the material, requirements or deadlines change, or if we discover that the original information was incomplete or inaccurate.
Your order is accepted once we send you a written confirmation, or once we begin performing the Services at your request. At that point a binding contract is formed, consisting of these Terms, your written quote or order confirmation, and any additional written conditions agreed between you and us.
4. Prices, payments and taxes
Unless stated otherwise in writing, prices shown on the Website are indicative only and may be updated at any time. The exact price for your order will be set out in your quote or order confirmation. You agree to pay all fees specified, in the currency and within the time period indicated. We may require full or partial payment in advance, particularly for certified, urgent or high-value projects.
You are responsible for any bank charges, transfer fees or taxes that apply to your payment. If you fail to pay any amount due, we may suspend the Services and/or withhold deliverables until full payment is received.
Non-refundable fees. Our translations are prepared specifically for you and cannot be resold or reused, so all fees paid for the Services are non-refundable once payment has been received, whether or not the Services have been fully performed at the time of any request. This applies in particular to certified, sworn, notarized, urgent and customized translations. If you believe there is an error, omission or non-conformity, your remedy is set out in Section 8, not a refund. Nothing here affects rights you may have under mandatory consumer-protection laws that cannot be excluded or limited by contract.
5. Use of the Website
You agree to use the Website only for lawful purposes and in a way that does not infringe the rights of, or restrict the use and enjoyment of the Website by, anyone else. You must not: violate any applicable law; attempt to gain unauthorized access to the Website, its servers or related systems; upload or transmit any material that is unlawful, defamatory, discriminatory, fraudulent, obscene or otherwise objectionable, or that contains viruses, malware or harmful code; or use any automated device or method to access, copy or monitor any part of the Website without our prior written consent.
We may suspend or terminate your access to the Website at any time if we believe you have violated these Terms or any applicable law.
6. Your documents and content
To provide the Services we may ask you to provide documents and materials that may include personal, confidential or sensitive information ("Client Materials"). By providing Client Materials, you confirm that you have all necessary rights and permissions to share them with us; that they do not infringe the rights (including copyright, confidentiality or privacy rights) of any third party; and that they do not contain unlawful content.
You grant us a limited, non-exclusive, worldwide license to use, reproduce, store and process the Client Materials solely as necessary for us, our staff and our contractors to provide the Services and to comply with our legal obligations. We treat Client Materials as confidential and handle them in line with our Privacy & Cookies Policy. However, you understand that electronic transmission is never completely secure, and we cannot guarantee that unauthorized third parties will never defeat our security measures.
7. Delivery of translations
We will use reasonable efforts to deliver by the agreed deadline. However, all delivery dates are estimates unless explicitly guaranteed in writing, and we are not liable for delays caused by events beyond our reasonable control (see Section 15). Unless agreed otherwise, translations are delivered electronically (for example, by email or through a secure link). If you require printed, notarized or otherwise physically delivered documents, additional fees and delivery times may apply.
8. Review, corrections and complaints
You agree to review all deliverables promptly upon receipt. If you believe there is any error, omission or non-conformity with the agreed specifications, you must notify us in writing as soon as possible and in any case within a reasonable period after delivery. We may, at our discretion, review the deliverables, make reasonable corrections or improvements, and/or offer an appropriate remedy in line with our quality policies. Corrections outside the scope of the original order (for example, changes in style, tone or terminology not agreed at the outset) may be treated as additional work and charged separately.
9. Document retention and re-supply
We keep your documents and finished translations for a limited time only — normally three (3) months from delivery — and then permanently delete them. You are responsible for downloading and saving your completed translation from the secure link we provide within that period.
If, after that period, you want changes to a translation, an additional certified copy, or added notarization or apostille, you will need to supply the underlying document(s) to us again so we can carry out the work, and the request may be treated and priced as a new order.
This retention practice protects the confidentiality of your sensitive documents by not keeping them longer than necessary. It is described further in our Privacy & Cookies Policy. Records we are legally required to keep (such as invoices and tax records) are retained for the longer periods the law requires.
10. No legal or professional advice
We are a translation and language-services provider. While we may work with lawyers, immigration professionals or other advisers, any information we provide is for general guidance on translation and related matters only. Nothing on the Website or in our communications is legal, immigration, tax, medical or other professional advice. You should always consult your own qualified advisers, and you remain solely responsible for how you use translated documents and for any decisions you take based on them.
We are not a law firm and not a government agency. EKO 4 is a private document translation, notarization and apostille service. We are not affiliated with, endorsed by, or acting on behalf of U.S. Citizenship and Immigration Services (USCIS), the U.S. Department of State, the Florida Department of State, any court, or any other government agency. We cannot select immigration forms or benefits for you, advise you on your eligibility, or represent you before any government agency or court. If you need legal advice, consult a licensed attorney or a representative accredited by the U.S. Department of Justice.
11. Acceptance by third parties
Many of our translations are prepared for use with government agencies, courts, universities, employers and other third-party organizations. While we follow relevant standards and you may see references on the Website to high acceptance and quality levels, the final decision to accept or reject any translated document always rests with the receiving organization. We cannot and do not guarantee that a specific third party will accept a document in every case, because acceptance may depend on factors outside our control (such as changes in that organization's policies, your underlying documents, or your individual circumstances). Any guarantees mentioned on the Website are subject to the terms of your specific quote or order confirmation and to your prompt cooperation, including providing accurate and complete original documents.
12. Intellectual property
EKO 4 TRANSLATION SERVICE FLORIDA® is a service mark of EKO 4 Global Services Ltd, registered with the United States Patent and Trademark Office (Reg. No. 6,352,162). Unauthorized use of the mark is prohibited.
The Website and its contents (text, images, logos, graphics, icons, software and layout) are owned by or licensed to EKO 4 and protected by copyright, trademark and other laws. You may view, download and print content from the Website for your own personal or internal business use only, provided you do not remove any proprietary notices, do not modify the content, and do not use it for any commercial purpose without our prior written consent.
Subject to full payment of the applicable fees, we grant you a non-exclusive, non-transferable license to use the translations we produce for you for the purposes you specified when placing your order (for example, submission to a particular authority, court or institution). All other rights are reserved.
13. Copyright complaints (DMCA)
We respect the intellectual-property rights of others. If you believe content on the Website infringes your copyright, please send a written notice to info@translationsflorida.us including: identification of the copyrighted work; identification of the material you claim is infringing and its location on the Website; your contact details; a statement that you have a good-faith belief the use is not authorized; and a statement, under penalty of perjury, that the information in your notice is accurate and that you are the owner or authorized to act on the owner's behalf. We will respond to properly submitted notices in accordance with applicable law.
14. Data protection and privacy
We collect and process personal data in connection with the Website and the Services. Our use of your personal data is described in our Privacy & Cookies Policy, which forms part of these Terms. By using the Website or the Services, you acknowledge the collection and use of your data as described there.
15. Force majeure
We are not liable for any delay or failure to perform if it is caused by an event beyond our reasonable control, including acts of God, natural disasters, epidemics or pandemics, war, terrorism, civil unrest, strikes or labor disputes, power or telecommunications failures, or the failure of any third-party systems or services.
16. Disclaimers
THE WEBSITE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, WE MAKE NO WARRANTIES OR REPRESENTATIONS, EXPRESS OR IMPLIED, ABOUT THE WEBSITE, INCLUDING ITS AVAILABILITY, ACCURACY, RELIABILITY OR SUITABILITY FOR ANY PARTICULAR PURPOSE. We do not warrant that the Website will be uninterrupted or error-free, or that it will be free of viruses or other harmful components. You are responsible for implementing appropriate safeguards (such as anti-virus protection).
17. Limitation of liability
Nothing in these Terms excludes or limits our liability where it would be unlawful to do so, including liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation.
TO THE FULLEST EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, BUSINESS, CONTRACTS, GOODWILL OR ANTICIPATED SAVINGS, ARISING FROM OR IN CONNECTION WITH YOUR USE OF THE WEBSITE OR THE SERVICES. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE WEBSITE, THE SERVICES AND THESE TERMS (WHETHER IN CONTRACT, TORT, NEGLIGENCE, STATUTE OR OTHERWISE) IS LIMITED TO THE TOTAL AMOUNT OF FEES YOU ACTUALLY PAID TO US FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM.
18. Indemnity
You agree to indemnify, defend and hold harmless EKO 4 and its officers, directors, employees and contractors from and against any claims, liabilities, damages, losses and expenses (including reasonable legal fees) arising out of or connected with your use of the Website or the Services, your breach of these Terms, or any claim that the Client Materials you provide infringe the rights of any third party or violate applicable law.
19. Third-party links
The Website may contain links to third-party websites or services that are not owned or controlled by us. We have no control over, and assume no responsibility for, the content, privacy policies or practices of any third-party websites or services. You access any third-party websites at your own risk.
20. Changes to these Terms
We may update these Terms from time to time, for example to reflect changes in the law, our Services or our business practices. When we do, we will update the "Last updated" date at the top of this page. Your continued use of the Website after changes are posted constitutes acceptance of those changes. If you do not agree to the revised Terms, you must stop using the Website and the Services.
21. Governing law and jurisdiction
To the extent permitted by law, these Terms and any dispute arising out of or in connection with them (including non-contractual disputes) are governed by the laws of the State of Florida, United States of America, without giving effect to conflict-of-law rules. You and we agree that the state and federal courts located in Florida will have exclusive jurisdiction over any dispute or claim arising from or relating to these Terms or your use of the Website or Services, subject to any mandatory consumer-protection rules that apply in your state or country of residence.
